The Government’s Decision
The government complied with the Kalpetta court’s judgment and decided not to pursue further legal proceedings, even though the government pleader had recommended an appeal. The Home Department also told the State Police Chief to start recovering the amount from the two former police officers, held responsible for the illegal arrest and torture.
Surendran had recently met Chief Minister V.D. Satheesan and asked him not to delay justice by filing another appeal.
What Happened in 2003
According to the government order quoted by The Hindu, police forcibly removed Surendran from the staff room at the District Institute of Education and Training in Sulthan Bathery, dragged him across the floor in front of colleagues and students and took him away in a police jeep without giving a reason.
At Sulthan Bathery police station, the order records, he was beaten, kicked and punched and denied food and water. He was not produced before a magistrate within the required 24 hours, and his family was not properly informed. He was later implicated in three criminal cases connected with the Muthanga incident.
Why It Matters
The order puts the cost on the individual officers held responsible rather than on the public purse. The Hindu described the outcome as bringing “a measure of relief” after 23 years.
